Seller Rules/Agreements

Agree that there are no contingencies to your auctions or sales events other than those stated in this User Agreement and, with respect to a specific auction or sales event, in the Asset's Listing.

Seller shall maintain accurate contact information and shipment information with respect to your user account (for example, physical location of the assets being sold, and whether there is a loading dock available) and a contact name and number at asset location.

Seller shall not sell any counterfeit, stolen or any of the prohibited assets set forth on our Prohibited Asset List found here, which will be updated at our discretion.

Seller is responsible for posting all relevant information in the Listing necessary to sell and convey the Assets;

Seller is responsible for providing any lien or payoff information prior to listing their item(s), with a 30 day total payoff and any per diem.

Listing Requirements.

GovWorld reserves the right to accept or reject any or all Listings. Further, GovWorld reserves the right to review, edit or remove any Listing that we believe is inaccurate or misleading. We are not responsible for any misrepresentations made by you, or any confusion caused by our removal of any Listing. GovWorld shall remain the selling agent for you, the seller.

Consignor Guarantees or Warranties.

You own the Assets being sold and have marketable legal title to such Assets, free and clear of any lien, security interest, leasehold interest, co-ownership interest, or any other type of encumbrance.

You have authority to list the Assets for sale, to sell the Assets, and to transfer title of the Assets to a buyer; and you are complying with all laws and regulations applicable to the sale of your Assets.

Your failure to complete the sale of Assets to a qualified buyer could result in damages to us. Such damages will become immediately due and payable by you to us. Should any additional shipping costs be incurred because of incorrect shipping information or preparation, you agree to pay for these costs.

No Guarantees.

You acknowledge that despite our efforts, buyers may fail to complete the sale. We do not provide any representations or guarantees that buyers will pay you the agreed price or pay within a timely manner. In such case, GovWorld reserves the right to ban the buyer from any future auctions, and will relist the item on an upcoming auction.

Sellers of Titled Vehicles, Trucks and Trailers

Sellers of vehicles, trucks or trailers, along with any titled item, agree to deliver an original certificate of title to new owner (buyer) within 30 days of payment. Titles may be subject to any restrictions as indicated in the Listing or imposed by applicable law. Open titles cannot be issued, unless permitted by the DMV. Any Entity wishing for GovWorld to handle ownership transactions can request this service (see fee schedule).

Flat Items or No Bids

Any Flat Items or No Bid items, shall be charged a $25 No Bid fee after the initial offering, unless earlier agreements have been made. These are items that received no bids or offers the first time at auction.

Buyer Rules/Agreements

In order to register for any auction or sale, as a buyer, you must:

Provide all company and personal information required

Agree to all Terms and Conditions, Guarantee to abide by all auction rules, and:

Pay for all winning bids or sale prices, within the allocated time.

Agree with any requirements, listing terms, conditions and auction announcements.

Have no outstanding balance.

Provide any information such as, bank letter of credit, proof of funds, wiring information, etc.

Do your own due diligence, research and knowledge of item being sold, prior to bidding.

Agree that all sales are final, and guarantee payment for all winning bids.

Agree that all winnings bid are final, and not subject to negotiation, modification or amendment.

Hold GovWorld harmless from any discrepancy.

Agree to comply by all laws, rules and regulations set forth by customs for export, transport and resale.

Agree that any information provided by any GovWorld employee, is only for guidance. GovWorld does not guarantee any information provided and passed along to any buyer.

I agree that as the buyer I am buying each item As Is with any and all faults.

Bidding Process

Any buyer submitting the highest bid, will be deemed "Winning Bidder" at auction close. Buyer is then legally bound to the terms and conditions set forth, User Agreement and any Laws.

Bidder is responsible for any and all bids placed using his or her bidding number. No exceptions!

Bids may be placed by the buyer using the live bid button, or by placing a proxy bid on the item being sold. GovWorld does not guarantee any bid placed via the webcast, due to connectivity, or internet problems.

Payment Settlement:

The winning bidder agrees to make full payment in a timely manner, which is stated in the Terms and Conditions of each sale, including buyer’s premium, taxes, and any other fees that pertain to his/her purchases.

All payments will be in U S dollars, unless otherwise stated.

All payments will be wire transfer, cashier’s check, money order, company check (with bank letter of guarantee) or cash Credit Cards are accepted with corresponding surcharges.

No item will be released until all funds have cleared the bank. No exceptions!

Any credit card "charge backs" without the consent of GovWorld, will immediately result in the termination of your account, and any and all charges GovWorld can have said buyer charged with by the proper law enforcement agency, including any and all damages

Fees:

All fees and charges will be stated prior to each and every auction. These fees and charges may vary, depending upon the circumstances of each auction. They will be stated here, and in the "Terms and Conditions" of each individual sale. Please note, that unless otherwise stated before each auction, in the "Terms and Conditions" of said auction, the fees stated here will apply to that auction.

The "Buyers Premium" will be stated here also, and will hold to each individual auction, unless otherwise stated in the "Terms and Conditions" of said auction.

Inspection of Items:

All inspections of items being sold, must be done prior to item being sold. Inspection dates and times will be listed for each individual auction.

Any potential buyer, during inspection, assumes the risk of personal injury, damages, or any other loss of person or property, and will specifically release the seller and GovWorld from any liability.

Delivery/Removal of Items:

The buyer is responsible for removing their purchased item within a timely manner, stated within the "Terms and Conditions" of each individual auction. If no time is stated for said auction, the time frame will be set by GovWorld. In the event an item is not picked up during the specified time, removal, transport and storage fees will occur.

The buyer is totally responsible for loading and transportation.

The buyer is responsible for any and all cost pertaining to the removal of items, including packaging, wrapping, wiring, etc. The buyer is also for the complete removal of all items involved in winning bid.

All buyers assume the risk of injury or personal loss, including any third party members helping in the removal process, and releasing the seller and GovWorld from any liability.

Warranty/Guarantee Disclaimer:

Unless implied in the "Terms and Conditions" or the description of said piece, all items will be sold "AS IS, WHERE IS, WITH ANY AND ALL FAULTS".

PURCHASES BECOME THE RESPONSIBILITY OF AND SHALL BE AND REMAIN AT THE RISK OF THE PURCHASER IMMEDIATELY UPON ACCEPTANCE OF HIS BID. IT SHALL BE THE RESPONSIBILITY OF THE PURCHASER TO INSURE HIS PURCHASES IMMEDIATELY.

NO SALE SHALL BE INVALIDATED BY REASON OF ANY DEFECT OR INACCURACY IN ANY OF THE LOTS BY REASON OF THEIR BEING INCORRECTLY DESCRIBED IN THIS LISTING OR ELSEWHERE AND NO LIABILITY SHALL BE BORNE BY THE AUCTIONEERS IN RESPECT OF ANY SUCH FAULT OR ERRORS. THESE LISTINGS HAVE BEEN PREPARED ONLY AS A GUIDE BASED ON INFORMATION FROM SOURCES GENERALLY BELIEVED TO BE RELIABLE AND FROM THE CONSIGNOR BUT THE ACCURACY THEREOF CANNOT BE GUARANTEED OR WARRANTED BY THE AUCTIONEERS. BIDDER ACKNOWLEDGES THAT IT IS HIS RESPONSIBILITY TO INSPECT ALL EQUIPMENT AND TO MAKE HIS OWN INQUIRIES.

THERE SHALL BE NO GUARANTEES OR WARRANTIES, EXPRESSED OR IMPLIED STATUTORY OR OTHERWISE OF ANY NATURE WHATSOEVER. EACH AND EVERY LOT WILL BE SOLD "AS IS" "WHERE IS." SPECIFICALLY, BUT NOT TO RESTRICT THE GENERALITY OF THE FOREGOING, THE AUCTIONEERS MAKE NO REPRESENTATION OR WARRANTY ON ANY OF THE LOTS WHICH ARE THE SUBJECT OF THE AUCTION.

SINCE THE PROPERTY SOLD IS SECOND-HAND PROPERTY, SELLER MAKES NO WARRANTY OF ANY KIND AND SELLS THE GOODS ON AN "AS-IS" BASIS, FURTHER, SELLER MAKES NO WARRANTY OF ANY KIND WHATEVER, EXPRESSED OR IMPLIED: AND ALL IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE HEREBY DISCLAIMED BY THE SELLER.
